US Patent and Trademark Office’s Examiner Issues Final Decision in Favor of Azbil BioVigilant
TUCSON, AZ – January 6, 2014 – Azbil BioVigilant, Inc., (www.biovigilant.com), inventors of Instantaneous Microbial Detection™, announced today that, for a third and final time, the Examiner for the US Patent and Trademark Office (USPTO) has issued a decision rejecting TSI’s latest arguments in the reexamination of U.S. Patent No. 6,831,279. Specifically, on December 19, 2013, the USPTO found that all claims of TSI’s patent are unpatentable. As is customary, the Office has issued a Right of Appeal Notice (RAN) allowing 30 days in which TSI may appeal the Examiner’s final decision to the Patent Trial and Appeal Board.
