US Patent and Trademark Office Rejects TSI Claims in Patent Reexamination

TUCSON, AZ – March 25, 2013 – Azbil BioVigilant, Inc., (www.biovigilant.com), inventors of Instantaneous Microbial Detection™, announced today that the U.S. Patent and Trademark Office (USPTO) has issued a decision rejecting TSI’s latest arguments in the reexamination of U.S. Patent No. 6,831,279. Specifically, on March 19, 2013, the USPTO found that all claims of TSI’s patent are unpatentable. The TSI patent is also the basis for TSI’s patent infringement lawsuit against Azbil BioVigilant. TSI failed in a prior litigation filed in Minnesota against Azbil BioVigilant on the same patent, voluntarily dismissing the action.
